Draft Minutes of the meeting of Withiel Parish Council held at the Village Hall on Wednesday 6th

August 2014, starting at 7:15pm.

 

295/14 Attendance Cllr Kirkby (Chair) Cllr Coy Cllr Shearer, Cllr Harper, Cllr Malone, Cllr Nott-

Bower,Cllr Cubitt , also present: County Councillor Chris Batters , Parish Clerk R Turner and six

members of the public.

Cllr Coy joined the meeting approx 10 minutes after the start

296/14 Declarations of interest and requests for dispensations: None

297/14 Approval of the minutes of the Withiel Parish Council meeting of July 2, 2014. Proposed

Cllr Kirkby, seconded Cllr Cubitt, passed unanimously.

298/14 Invitations to address the meeting.

– Cornwall County Cllr Chris Batters reported that Ruthern Bridge would be closed 13th

October for repair work on the grade 2 listed bridge

– Matthew Williams and John Partridge both commented upon the ongoing issue of vehicles

reversing at Great Brynn Farm at unsocial hours. Cornwall Council Environmental

Protection Officer Jason Drew is acting and may attend the site at a future date once a diary

of events has been collated

– County Cllr Batters advised that all works required to repair the parish’s roads were

scheduled and would be completed by the end of 2014 and funding was secured.

– Sara Newton reported that Blackhay bridleway was overgrown and impassable. This issue is

to be referred by Cllr Shearer as footpaths officer to a contractor.

299/14 Matters arising from the July 2nd minutes and are not agenda items below:

– Cllr Malone reported that the parish was unlikely to benefit from superfast fibre optic

Broadband in the near future (see minute 243/14) and that explanations as to the reasons

would be set out by a consultant after a meeting to be arranged. County Cllr Batters advised

there were other parishes similarly effected, Lanhydrock being an example.

– Cllrs Kirkby & Shearer reported on their attendance at the Bodmin Network July meeting,

neighbourhood plans were discussed and that other parishes were considering

the implementation of a plan, but were also considering the consequences of their becoming

legal documents after going to referendum and a plan being agreed. It was reported that

Cornwall County as an entity has no neighbourhood plan. Next BN meeting date 22nd

October 2014.

 

300/14 Finance: Cllr Kirkby confirmed the bank balance to be £3529.49 credit

– To approve the purchase of a laptop computer and data sticks for use in the clerk’s role

within a budget of £215. Proposed by Cllr Kirkby , seconded Cllr Malone. Approved

unanimously. It was resolved that cheque no. 100496 be issued for £211.71 (VAT £35.29 to

be reclaimed) and accounted for under the repairs & renewals precept. Proposed Cllr

Kirkby, seconded Cllr Malone. Approved unanimously. It was stated that this expenditure is

to be in lieu of purchase of books for clerk’s role minuted 288/14.

– To authorise payment for printing the public questionnaire minuted 277/14. Resolution to

issue cheque no. 100498 sum of £95.80 and account under stationery precept. Proposed Cllr

Shearer, seconded Cllr Nott-Bower. Approved unanimously.

– To approve and complete variation to bank mandate allowing new clerk read only internet

access to the Bank account at HSBC. Proposed Cllr Kirkby, seconded Cllr Shearer.

Approved unanimously.

 

301/14 Footpaths:

– Cllr Shearer confirmed that the official opening of the new Lawellan bridge would take

place 8th August with a representative from the site contractors attending and that press

coverage is arranged.

– Cllr Shearer advised that all parish footpaths will be walked by the councillors during

August to report on their order and upkeep.

– To follow up minute 275/14 re the diversion of a footpath at Whitehay. With full reference to

Cornwall Council’s letter dated 23rd July, it was proposed by Cllr Kirkby, seconded Cllr

Shearer and approved unanimously in favour of the diversion.

302/14 Emergency Plan and Neighbourhood Plan. Councillors to distribute questionnaires through

out parish. Agreed.

303/14 Planning:

-Application PA14/06190 – Applicant Rodger Matthews

Location – Great Brynn Barton, Roche. Proposal – Erection of a side extension to an existing agricultural

building. It was resolved by 6 votes to 1 to object to this application, proposed Cllr Kirkby, seconded

Cllr Malone, on the grounds of potential environmental issues leading to a severe adverse impact on

the surrounding infrastructure and countryside and also it is considered that previous applications by

the landowner have proceeded outside of the terms of the planning permissions granted. Cllr Harper

voted in favour of the application. Decision recorded on county planning portal.

-Application PA14/06287 – Applicant Roger Matthews, Location –Great Brynn Barton, Roche.

Proposal – Erection of a single wind turbine with maximum 77 m tip height and associated infrastructure. It was

resolved by 6 votes to 1 to object to this application, proposed Cllr Kirkby, seconded Cllr Malone, on the

grounds of cumulative impact, flicker,noise and failure to provide a community assessment. Cllr Harper

voted in favour of the application. Decision recorded on county planning portal.

– Application PA 14/06616 – Applicant Roger Matthews, Location – Great Brynn Barton, Roche. Proposal –

Erection of a single wind turbine with maximum 77 m tip height and associated infrastructure. Associated

screening application to PA14/06287 not subject to statutory consultation or notification requirements – no vote

required.

-Refer application PA07/02060 where the conditions of planning at Great Brynn farm have not

been complied with. It was agreed that a site meeting with county planning department be sought as

soon as possible. Proposed Cllr Kirkby, seconded Cllr Shearer – vote in favour of action 6 to 1 with

Cllr Harper against action.

-Application PA14/06625 – Applicant Nick Parsons, Location – Homer Park, Withiel. Proposal

– Erection of single storey extensions, erection of a detached single storey replacement domestic

garage and erection of a detached block of 10 cat boarding chalets within the rear garden. Agreed

proposed Cllr Kirkby, seconded Cllr Malone. Approved unanimously.

-Email from CALC re obtaining gov.uk web address – WPC to proceed and request

-Email from CALC re LAIS1367 Deregulation Bill – to be circulated to Cllrs

-Letter from Cornwall Council re Planning Conferences for local councils – attendance agreed and

to be arranged at St Austell 18th November 2014 – cost £10 per delegate.

-Code of Conduct Training course – Roche 18th September 2014 – attendance agreed and to be

arranged – Cost £NIL.

305 /14 Invitation to members of the public to address the meeting. None

306/14 Date of next ordinary meetings: Wednesday 3rd September, Wednesday 1st October &

Wednesday 5th November.
