Minutes of the meeting of Withiel Parish Council (WPC) held at the Village Hall on Wednesday 3rd August 2016, which opened at 7:15 pm with Cllr Shearer welcoming and thanking all present for attending

Present: Cllr Shearer (Chair), Cllr Cubitt , Cllr Nott-Bower, Cllr Harper, Cllr Hoyle, Cllr Malone & Cllr Coy.

Also present: County Cllr Chris Batters, Parish Clerk, R Turner & five members of the public .

101/16 Apologies for absence:

PCSO Crocker (alternative duties).

102/16 Members Declaration of Interest and any requests for dispensations:

Cllr Nott-Bower declared his interest in agenda item 107/16(4).

103/16 Invitation to members of the public to address the meeting:

Cllr Batters informed that Biffa have taken over Cory Environmental Services, so residents would see a different logo on refuse collection vehicles in future. He went on to give members of the council some guidance with regard to the National Planning Policy Framework and in particular, development in rural areas.

Cllr Ray Jarrett, chair of St Breock Parish Council introduced himself and advised he was attending the meeting with a fellow St Breock council member and the purpose of their attendance was to illicit support from WPC to review the management of the R.E.G. Community Fund from which Withiel benefits. Cllr Cubitt asked for a written request which Cllr Jarrett handed to the Chair and Cllr Shearer read the proposed conditions contained within the document and advised the matter would be placed on the agenda of WPC’s September meeting.

Cllr Steve Walker introduced himself as vice chair of Lanivet Parish Council and advised his reason for attending the meeting was to illicit WPC’s support in formulating a strategy to make decisioning at the area network panel meeting’s more equitable for the outlying parish’s. In explaining his rationale, he gave examples where Bodmin Town Council were on the front foot at these meeting’s and were able to gain the advantage and benefit on the greater percentage of decision’s made, whilst the outlying parish’s are providing services and functions for some residents of Bodmin. Cllr Shearer advised the matter would be placed on the agenda of WPC’s September meeting for full discussion.

Cllr Shearer advised that an email had been received from PCSO Crocker to give apologies for her absence at this meeting and it included the following monthly report: 1 dog not under proper control, 1 driving offence, 1theft from a business and a report of 12 suspicious males sat at the roadside but not located by the Police on arrival.

Cllr Batters left the meeting at this point.

104/16 To approve the minutes of the council meeting held on 6th July 2016.

Cllr Coy proposed to approve the minutes of the meeting of 6th July 2016, seconded by Cllr Shearer. It was resolved unanimously to approve the minutes of the 6th July 2016.

105/16 To consider matters arising from minutes of 6th July 2016 which are not agenda items below.

Planning Application PA16/05119.

Cllr Shearer explained that WPC had been advised that the County Planning officials consider the application for the proposed dwelling replacing an existing building does not provide the justification for a dwelling which is necessary to enable a recommendation of approval. The applicant was present and explained her route to making the planning application. In accordance with the agreed ‘Protocol for Local Councils’, the options for WPC to consider in reply the County Planning officials were discussed. Cllr Malone proposed that WPC re confirmed it’s support for the application, as the location is in the heart of the community and that it will maintain the vitality of our rural community and encourage this younger applicant to remain in Withiel. Furthermore the scheme is considered to be infilling the site with a building of improved quality and design which will be sensitive to defining the characteristics of the local area. The proposal was seconded by Cllr Hoyle and it was resolved unanimously to re confirm support of the application.

106/16 Finance matters.

Accounts payable as follows:

1) CALC (Chairmanship Training) £24 – chq no. 100549.

2) Postages £0.55 (News & Views donation chq) – chq no. 100550

Cllr Coy proposed these payments and Cllr Malone seconded and it was resolved by an unanimous vote to make these payments.

Responsible Finance Officers report.

The clerk advised that the certified Annual Return for WPC for the year ended 31st March 2016 had been received from the external auditor and the Notice of conclusion of Audit had been posted on Withiel.com, in accordance with the statutory requirement and is contained in the following link;


The clerk also advised that the Neighbourhood Development Plan grant spend to date is £305.60 gross therefore £2694.40 is left from original sum.

107/16 Planning: To consider and approve a consultee comment for the planning applications listed below.

    1. PA16/05119 Location: Gwynne Moor, Withiel, Bodmin, Cornwall. Proposal: Conversion and extension of barn to provide habitable accommodation to be used as holiday let. Installation of new septic tank within the garden connected to a soak-away. Applicant: Mr A Jones.

Cllr Malone proposed the following consultee comment. WPC supports the application no. PA16/05119 as it appears to meet all current planning criteria and will serve to preserve a dilapidated building,

The consultee comment as proposed was seconded by Cllr Harper and it was unanimously resolved to approve the comment.

    1. PA16/05483 Location: The Old Rectory, Withiel, Bodmin, Cornwall. Proposal: Listed building consent; Erection of outbuilding. Applicant; Mr Joseph Maguire.

Cllr Harper proposed the following consultee comment. WPC does not oppose the application no. PA16/05483 but has concerns that the applicant advised on the application form that neighbours had not been consulted and allowed to express a view on the proposal at that stage,

The consultee comment as proposed was seconded by Cllr Shearer and it was unanimously resolved to approve the comment.

    1. PA16/00009/NDP Plan proposal and strategic environmental assessment report for Roche Parish Neighbourhood Development Plan.

Cllr Cubitt proposed the following consultee comment.

A very comprehensive, thorough and professional set of documents which clearly layout the whole process of developing,consulting and submitting a neighbourhood development plan (NDP). We have no specific observations to make on any part of it. We note that it has been drafted with the explicit intention to offer templates for use by other NDP steering groups and it is our intention to adapt some of those templates where relevant e.g. in the design guide. We look forward to working with Roche parish council on the development and regeneration of the Victoria Square site.

The consultee comment as proposed was seconded by Cllr Malone and it was unanimously resolved to approve the comment.

Cllr Nott-Bower left the room at this point in the meeting.

    1. PA16/06318 Location: Wayside Cottage, Tregawne, Withiel, Bodmin. Proposal: Proposed extensions, alterations and garage conversion. Applicant: Mrs Emily Nott-Bower.

Cllr Malone proposed the following consultee comment.

WPC supports the application which provides for family accommodation and encourages a family to remain in the village. We would have liked to have seen a design and access statement for the proposed redevelopment.

The consultee comment as proposed was seconded by Cllr Cubitt and it was unanimously resolved to approve the comment.

Cllr Nott-Bower returned to the meeting.

108/16 Planning: To report planning decisions of the planning authority received prior to the evening of the meeting.

PA16/04252 Location: House of Fishes, Moorland View Farm, Inches, Bodmin. Proposal: Formation of new vehicular access, construction of garage and alterations to approved parking layout. Applicant: Mr C Moore.

Decision: Approved

109/16 Neighbourhood Development Plan (NDP).

Cllr Cubitt confirmed that the process for completing the Withiel NDP remained on track.

110/16 Public Engagement Event 14th July 2016. Cllr Cubitt reported on Cornwall Council’s review into governance and public spending.

111/16 Bodmin Community Network Meeting 13th July 2016. Cllr Shearer reported.

112/16 To discuss and consider the installation of a passing bay on the road between Withiel and Withielgoose.

A short discussion took place which concluded there was insufficient information available about the specific positioning of a passing bay to move the matter forward. Relevant information is to be gathered for presentation at a future meeting.

Cllr Hoyle left the meeting at this point.

113/16 Correspondence. (For information only)

  • Clerk’s absence advised as being 20th August 2016 until 6th September 2016.

  • Highways advise A30 lane closures between Summercourt and Bodmin commencing 8th August 2016 until 27th September 2016, Monday to Friday and overnight only 8pm until 3.30am.

  • Cornwall Local Plan. Cllr Cubitt advised a copy of the schedule and Cllr Carlyon’s comments have been received, but considers we do not need to make any particular comment.

  • Cornwall Home Improvement and Self Build Show 1st – 2nd October, RCS Wadebridge. Tickets available online.

114/16 Advise dates of next normal meetings as being 7th September 2016, 5th October 2016 & 2nd November 2016.
