Draft WITHIEL PARISH COUNCIL
Minutes of the meeting of Withiel Parish Council (WPC) held at the Village Hall on Wednesday 7th December 2016, which opened at 7:15 pm with Cllr Shearer welcoming and thanking all present for attending.
Present: Cllr Shearer (Chair), Cllr Cubitt , Cllr Coy, Cllr Harper, Cllr Hoyle , Cllr Nott-Bower & Cllr Malone.
Also present: Parish Clerk- R Turner and four members of the public .
161/16 Apologies for absence: Cornwall Cllr Chris Batters.
162/16 Members Declaration of Interest and any requests for dispensations: None.
163/16 Invitation to members of the public to address the meeting: None.
164/16 To approve the minutes of the council meeting held on 2nd November 2016.
Cllr Malone proposed to approve the minutes of the meeting of 2nd November 2016, seconded by Cllr Shearer. It was resolved unanimously to approve the minutes of the 2nd November 2016.
165/16 To consider matters arising from minutes of 2nd November 2016 which are not agenda items below.
-Tourism project (see 148/16). It has been advised that the Cornwall Councillors Community Chest fund will contribute £200 to be added to a Local Devolution Grant of £500.
-Cork Wood rave 30th October 2016 (see148/16) The local Police have, via the clerk, asked for any one with information regarding this incident to come forward or report anonymously via Crimestoppers on 080055511 or through the online form on the Crimestoppers web site.
-Damage to hedging and property boundary treatments by large vehicles (see148/16). It has been advised that unless criminal damage can be proven with sufficient evidence, these incidents are not police matters. The local police sergeants’ advice for recurring hits that leave property owners with repair costs is to liaise with CORMAC to try and seek a solution.
166/16 Finance matters.
Accounts payable as follows:
1) Clerks Salary £406.53 chq no 100558.
2) HMRC PAYE £94.20 chq no 100559.
3) Agave Landscape Ltd £318.05 – Footpath cut – chq no 100560.
Cllr Shearer proposed these payments be made, Cllr Malone seconded and it was resolved by an unanimous vote to make these payments.
Responsible Finance Officers report.
The clerk reiterated that the Neighbourhood Development Plan (NDP) grant spend to date is £305.60 gross therefore £2694.40 is still being held from original sum received of £3000.
167/16 Planning: To consider and approve a consultee comment for the planning applications listed below. There were no requests for consultation that had not already been commented on.
168/16 Planning: To report planning decisions of the planning authority received prior to the evening of the meeting. No decision notices received.
169/16 Neighbourhood Development Plan. Cllr Cubitt had no further update to report but was satisfied with the work currently being undertaken by the relevant stakeholder agencies to bring the plan into being. He also highlighted the recent High Court ruling to turn down the challenge brought against St Ives Town Councils main residency condition on new house builds. Whilst other councils are now being encouraged to insert similar conditions into their NDP’s, Cllr Cubitt advised the process is very cumbersome and unlikely to be successful for Withiel on final review due to the low number of existing second homes in the Parish.
170/16 St Breock Wind Farm Community Fund.
Cllr Cubitt summarised the meeting of 16th November 2016, attended by representatives of the constituent parish panels. He advised that Withiel has lost a panel member and asked for a volunteer to come forward as a replacement. Details were also given regarding the timings of next years monetary distribution process.
171/16 Cornwall Local Councils Pre Application Planning Protocol.
To consider and if agreed, resolve to adopt the three part document containing the following :
i) Pre Application Agreement – this outlines the roles of each of the parties involved in the planning process. If adopted this agreement, will define WPC’s role and our requirements of the applicant. It also defines the role of the planning authority in supporting WPC through this process.
ii) Pre Application Protocol – the protocol explains how WPC will engage in pre application and clarifies the potential danger areas which should be avoided under the Code of Conduct.
Pre Application Planning Profile – Cornwall Council will hold this register of information about our parish and share it with any potential developer seeking pre application consultation in our area.
The Chair advised the meeting that this item of business will be deferred until the next normal meeting to be held in January 2017.
172/16 Correspondence. (For information only)
-Road closure 9th to 20th January 2017 09.30hrs to 16.00hrs Demelza Lane and Demelza Road to Brynn Mill.
-Cornwall Local Plan adoption notification dated 22nd November 2016.
-Local Town & Parish Council planning training confirmed as 15th December 2016 at Chy Trevail Bodmin.
173/16 Advise dates of next normal meetings as being 4th January 2017, 1st February 2017 & 1st March 2017.
These dates were confirmed.
Cllr Shearer closed the meeting at 7.40 pm. and once again thanked all those present for attending.
