Minutes of the meeting of Withiel Parish Council (WPC) held at the Village Hall on Wednesday 6th June 2018 which opened at 7:15 pm with Cllr Shearer welcoming all in attendance.

WPC Councillors present: Cllr Shearer (Chair), Cllr Cubitt, Cllr Hoyle & Cllr Malone.

Also present: one member of the public.

No declarations were made.

76/18 Invitation to address the meeting:

Cllr Shearer read Cllr Batter’s report in his absence: the electoral reform now looks like bringing Lanhydrock back into the Lanivet division and returning to the ‘doughnut’ ward that is there now, and retaining the additional Bodmin town area. The title of the division will be ‘Lanivet, Blisland & Bodmin West.’

Cllr Hoyle proposed to approve the minutes of the annual parish meeting of 2nd May 2018, seconded by Cllr Malone. It was resolved to approve the minutes of the annual parish meeting 2018. Cllr Shearer signed the minutes.

Cllr Malone proposed to approve the minutes of the annual council meeting of 2nd May 2018, seconded by Cllr Hoyle. It was resolved to approve the minutes of the annual council meeting 2018. Cllr Shearer signed the minutes.

80/18 Finance matters.

Cllr Hoyle proposed the payment of these accounts. Cllr Malone seconded the proposal and it was resolved to make the payments.

-Responsible Finance Officer’s report

The chair delivered the RFO’s report:

-NDP Locality Grant/ Groundwork UK grant proceeds, £1k, credited to bank 4.5.2018

-Withiel Parish Council’s Information Commissioners Office registration confirmed & certificate held dated 21.5.2018. Ref no ZA383333

– The WPC Annual Governance & Accountability Return has been sent for External Audit. The Exercise of Public Rights to inspect the accounts will commence Monday 18th June and conclude  Friday 27th July 2018. Details will be published on withiel.com and the village notice board in due course.

81/18 Planning: To consider and approve a consultee comment for the planning applications listed below and any others received prior to the evening of the meeting.

There were no applications that had not already been commented upon.

82/18 Planning: To report planning decisions of the planning authority received prior to the evening of the meeting.

83/18 S16 Kerriers Solar Farm Grant Fund.

The proposed grant of £965.88 from Withiel Playing Fields Assn for 12 months defibrillator running costs was discussed. Cllr Malone proposed and Cllr Hoyle seconded that this item be deferred until the next meeting when Cllr Coy will be present to inform about the current and future situation with this grant. It was resolved to defer this item until the next normal council meeting.

84/18 Neighbourhood Development Plan.

Cllr Cubitt advised that the signed decision sheet for formally making the Withiel Neighbourhood Development Plan, with an implementation date 4th June 2018, had been received from Cornwall Planning and Sustainable Development. The NDP is now part of the Cornwall planning regime. The meeting formally congratulated Cllr Cubitt on his work in carrying the plan through to a successful conclusion.

85/18 General Data Protection Regulations

Cllr Cubitt reported on the current situation. The GDPR came into effect on 25th May. It strengthens privacy rules and requires individuals and organisations to have robust procedures in place to protect privacy. The Parish Council collectively are the data controller i.e. the responsible body through a data audit officer working in liaison with the clerk as the data holder. Cllr Cubitt has agreed to act as data audit officer pro tem. Cornwall Council and the clerk have both issued advice for councillors on how to act within the GDPR regime and this has been circulated to members. The CALC is to produce standard privacy notices, one for staff & councillors and one for the general public, for adoption by town and parish councils. Until these arrive the clerk has drafted and posted onto the Withiel website a compliance notice, which Cllr Cubitt summarised.

86/18 Tree Wardens No expressions of interest in this work have been received to date. To be reconsidered, only should someone step forward with an interest in becoming a local community tree warden.

87/18 Correspondence (For information only)

1-St Breock Windfarm Comunity Fund Meeting 12th June 2018 7pm at the Betjeman Centre.

The purpose of the meeting is to review the constitution for the Community Fund, and to make plans for next years grant round.

2-Police Notice – Telephone scam usually from a 0203 number advising that money is owed, often tax. Advice is to hang up immediately and do not phone back if a message is left.

3-Ruthern Bridge – Intention to close 6th Aug – 15th Aug inclusive, 24 hours including weekends.

4- Severe Potholes. Cllr Batters has now lobbied Cormac, who have replied advising an immediate survey will be undertaken. Repairs will be carried out in due course in accordance with Cornwall Council’s Highways Maintenance Manual.

5- Briefing note from Cornwall Council regarding weight restrictions on local bridges. It notes that Ruthern Bridge has been classified as capable of taking the maximum permitted load of 44 tons.

88/18 Advised dates of next meetings as being 4th July 2018, 1st August 2018 & 5th Sept 2018.

These dates are confirmed.
