Minutes of the meeting of Withiel Parish Council (WPC) held at the Village Hall on Wednesday 2nd January 2019 which opened at 7:15 pm with Cllr Shearer welcoming all in attendance.

WPC Councillors present: Cllr Shearer (Chair), Cllr Cubitt, Cllr Coy, Cllr Harper, Cllr Nott-Bower. Also present: Two members of the public.

1/19 Apologies for absence: County Cllr Batters, Cllr Hoyle, Cllr Malone, Clerk (leave).

2/19 Members Declaration of Interest and any requests for dispensations:

There were no declarations of interests made.

3/19 Invitation to members of the public to address the meeting:

Members of the public raised the issue of road resurfacing at Withiel village. While this was welcome, slurry and building rubbish has been fly-tipped on the St. Wenn side of the Withiel Hill crossroads, blocking the passing bay. Cllr Shearer undertook to photograph the site and alert Rachel Tatlow at Cornwall Council to the problem. The issue of overhanging vegetation intruding into the roadway at Whitehay Hill was also raised. The adjacent landowners have not been given any advice about cutting back vegetation and believe they are in conformity with the requirements for main-tenance of verges.

4/19 To approve the minutes of the council meeting held on 5th December 2018.

Cllr Coy proposed to approve the minutes of the council meeting of 5th December 2018, seconded by Cllr Shearer. It was resolved to approve the minutes of the council meeting of 5th December 2018. Cllr Shearer signed the minutes.

5/19 To consider matters arising from minutes of 5th December 2018 which are not agenda items below. There were no matters arising.

6/19 Finance matters.

In the clerk’s absence Cllr Shearer gave the Responsible Finance Officer’s report

-Consideration of the third quarter financial report was deferred until the February meeting when the clerk will be present.

-£326.06 – LMP (Footpath) grant received from Cornwall Council.

-£965.88 S106 grant remittance received from Cornwall Council re Withiel PAD.

-Accounts payable

1- Withiel PAD (S106 grant) £965.88. Chq no.100624

Cllr Cubitt proposed the payment of this item which was seconded by Cllr Shearer. It was resolved to make the payment of £965.88 to Withiel PAD by chq no. 100624.

7/19 Planning: To consider and approve a consultee comment for the planning applications listed below and any others received prior to the evening of the meeting.

Application PA18/11541

Proposal Retention of existing lean-to roof, supporting posts and cladding panel and

construction of office below this roof.

After discussion Cllr Cubitt proposed the following consultee comment: Withiel Parish Council supports this application as it promotes the sustainable growth and expansion of this rural business through the conversion of an existing building. Cllr Harper seconded the proposed comment and it was resolved that the comment be submitted to the Planning and Sustainable Development Service.

8/19 Planning: To report planning decisions of the planning authority for Withiel Parish received prior to the evening of the meeting.

Cllr Shearer reported the following decision:

Application PA18/09230 -APPROVED.

Proposal Construction of a manège (riding school) and associated works.

9/19 Planning: To report, for information only, any pre application planning submissions to planning authority for Withiel Parish advised prior to the evening of the meeting.

There are no pre application planning submissions relating to Withiel to report.

10/19 Standing Orders –To adopt amendments to WPC standing Orders as recommended by National Association of Local Councils and commentary given by Cornwall Association of Local Councils dated 15.11.2018.

Cllr Harper proposed WPC adopt the amendments and Cllr Shearer seconded the proposal and it was resolved to adopt amendments as recommended by National Association of Local Councils and commentary given by Cornwall Association of Local Councils dated 15.11.2018 and rewrite WPC standing orders accordingly.

11/19 Cornwall Local Plan Affordable Housing, Housing Apportionment, Rural Exception Sites, and Conference Request

WPC’s position was considered in discussion with regard to Rural Exception Sites being over used to provide housing for non-local need, and the use of Economic Viability Appraisals to justify open market value housing. Cllr Nott-Bower proposed: That Cllr Cubitt be authorised to draft a comment and represent the council on any discussions subsequently arranged. Seconded Cllr Coy. Agreed that Cllr Cubitt should represent the Council’s position in any future discussions.

12/19 GDPR

The Chair agreed with members to defer this item until the clerk is present to give guidance.

13/19 Community Networks Highways Scheme – Whitehay Hill

Cllr Shearer reported that the landowner has given agreement in principle to release land sufficient to enlarge the lower passing place on Whitehay Hill and it has been passed to Cornwall Council to progress matters with the landowner.

After discussion Cllr Coy proposed we inform the commission that, while we do not feel the need for a governance review at this time, we note that under para 113 of the regulations (which specify that the minimum number of electors required for a parish to qualify as such is 150), Withiel continues to qualify as a parish council without the need to be amalgamated. Seconded by Cllr Harper. It was resolved that the commission be informed accordingly.

15/19 Correspondence. There were no items of correspondence.

16/19 Advise dates of next meetings as being 6th February 2019, 6th March 2019 & 3rd April 2019. These dates were confirmed and Cllr Shearer closed the meeting at 7.55 pm.
