Minutes of the meeting of Withiel Parish Council (WPC) held at the Village Hall on Wednesday 5th June 2019 which opened at 7:15 pm with Cllr Shearer welcoming all in attendance.

WPC Councillors present: Cllr Shearer (Chair), Cllr Cubitt, Cllr Malone, Cllr Hoyle, Cllr Nott-Bower .

Also present: Cornwall Cllr Chris Batters, Mr Mark Evans – Cornwall Council Planning & Sustainable Development, the Clerk and two members of the public.

88/19 Apologies for absence: Cllr Harper & Cllr Coy

89/19 Members Declaration of Interest and any requests for dispensations:

No declarations were made.

90/19 Invitation to members of the public to address the meeting:

Cllr Batters advised of a planned road closure at Tregustick Road, dates to be confirmed.

Mr Mark Evans, Principle Development Officer, who had accepted an invitation to attend this meeting, explianed the current structure, processes, policies, and service offering to town and parish councils from the Planning and Sustainable Development team at Cornwall Council. During Mr Evans peroration Cllr Batters left the meeting.

91/19 To approve the minutes of the annual Parish Meeting held 1st May 2019.

Cllr Hoyle proposed to approve the minutes of the annual Parish Meeting held 1st May 2019, seconded by Cllr Cubitt. It was resolved to approve the minutes of the annual parish meeting of 1st May 2019. Cllr Shearer signed the minutes.

92/19 To approve the minutes of the annual council meeting held on 1st May 2019

Cllr Cubitt proposed to approve the minutes of the annual Council meeting held 1st May 2019, seconded by Cllr Malone. It was resolved to approve the minutes of the annual Council meeting of 1st May 2019. Cllr Shearer signed the minutes.

93/19 Any matters arising from annual council meeting minutes of 1st May 2019 which are not agenda items below.

There were no matters arising.

94/19 Finance matters.

Responsible Finance Officer’s report.

1-An external audit of WPC Annual Governance & Accountability Return 2018/19 has been requested & acknowledged by the auditor. The exercise of public rights will commence 1.7.2019 and run until 9.8.2019.

Accounts Payable

1-     Norris & Fisher Insurance Brokers £235.85 Chq no. 100632

2-     Clerks salary Apr, May June 2019 £609.24 Chq no. 100633

3-     PAYE £138.60 Chq no. 100634

4-     Payline SW re payroll services until 31.3.2020 £70.56 Chq no.100635

Cllr Nott-Bower proposed the payment of these accounts. Cllr Shearer seconded the proposal and it was resolved to make these payments.

95/19 Planning: To consider and approve a consultee comment for the planning applications listed below and any others received prior to the evening of the meeting.

Application PA19/04122. Proposal: Certificate of Lawful Development for an Existing Use for the Erection of general purpose agricultural building. Location: Land At Tregustick Farm Withiel Bodmin PL30 5NG. Applicant: Mr Edward Piper.

The applicant was present and the Chair invited his comment to rationale the application. A brief discussion between members followed and Cllr Shearer proposed the following consultee comment:

Withiel Parish Council welcomes the diligence of the applicant in applying for a Lawful Development Certificate to confirm the lawfulness of the building and its agricultural use.

Cllr Nott-Bower seconded the proposed comment and it was resolved to approve and submit the comment to the Planning & Sustainable Development Service.

96/19 Planning: To report planning decisions of the planning authority for Withiel Parish received prior to the evening of the meeting.

Cllr Shearer reported the following decisions:

GRANTED: Application PA19/02457. Proposal Certificate of lawfulness for existing use for the conversion of barn into holiday accommodation (commencement of works under reference PA97/00460) Location Holiday Cottages Home Farm Beacon Hill Withiel. Applicant Mr and Mrs Birkby

GRANTED: Application PA19/02671 Proposal Certificate of Lawfulness for existing development for confirmation of commencement of works under PA16/04110 (Conversion of existing building to independent dwelling) Location Trebois, Pooleys Hill, Withiel, Bodmin Applicant Suzanne Darling

97/19 Planning: To report, for information only, any pre application planning submissions to planning authority for Withiel Parish advised prior to the evening of the meeting.

There were no pre application planning submissions relating to Withiel to report.

90/19 Complaints Procedure Policy Amendment

The clerk explained that the amended policy is as recommended by Cornwall Assn of Local Councils and conforming with the latest NALC model document. Cllr Malone proposed to adopt the policy document that had previously been circulated to the council members. Cllr Nott-Bower seconded the proposal and it was resolved to adopt the policy. The clerk undertook to publish the document and distribute an adopted copy to all members.

91/19 Press & Media Policy

The clerk asked for approval, for the sake of good governace and to support standing orders, to adopt the policy document that had previously been circulated to the council members. Cllr Hoyle proposed it’s adoption and Cllr Shearer seconded the proposal. It was resolved to adopt the policy. The clerk undertook to publish the document and distribute an adopted copy to all members.

92/19 Risk Assesment Policy.

To consider amendments to WPC Risk Assessment Policy, which had been previously distributed to members. The clerk asked the members present, to carefully sense check the updated policy to ensure it met current needs and is fit for purpose and acceptable for adoption at the July council meeting.

93/19 Freedom of The Parish Policy.

To consider a policy, which had been distributed to the members, to adopt in order to recognise past recipients and provide a basis for the future. The matter was discussed briefly and the policy is now tabled for adoption at a future meeting of the council.

94/19 Highways Engagement Session Bodmin held 9.5.2019.

Cllr Hoyle reported her attendance and that there was nothing to feedback.

95/19 GDPR – Annual review

The clerk advised that the GDPR annual review had been completed and signed off by Cllr Cubitt. The report was delivered to the meeting, highlighting the further action points to remediate two amber ratings and fully establish policies and processes to work toward comprehensive compliance with GDPR.

96/19 Proceeds from sale of asset

Cllr Shearer advised that there have been no proposals forthcoming for the commitment of funds held from the sale of the telephone box and WPC would welcome a scheme to be put forward.

97/19 Correspondence (For information only)

  • Withiel Playing Fields Association (WPFA)– the clerk read a letter received on the day of the meeting, from the committee of WPFA, seeking WPC assistance in raising funds for extremely urgent works required to bring the village hall up to current fire, health and safety standards. He advised this would be an agenda item for the July meeting.

  • Clerks absence 19.6.2019 until 1.7.2019. The clerk advised that the July Council meeting agenda will be posted as at 18.6.2019.

98/19 Advise dates of next meetings as being 3rd July 2019, 7th August 2019 & 4th September 2019.

These dates were confirmed and Cllr Hoyle tendered her apoligies for absence in respect of the August meeting.

Cllr Shearer closed the meeting at 8.36 pm.
